Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using DemandOrca (the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these terms, do not use the Service.

2. The Service

DemandOrca is a demand-monitoring tool that collects and analyzes public posts from Bluesky to surface customer demand, pain points, product requests, and buying intent. You create projects with keywords, and the Service continuously collects relevant public posts, classifies them, and clusters them into demand opportunities.

The Service is provided "as is" and "as available." We do not guarantee that the demand signals, scores, or opportunities we surface are accurate, complete, or commercially valuable. You are responsible for evaluating any opportunity before acting on it.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for safeguarding your password and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these terms or that we reasonably believe are being misused.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe the intellectual property or privacy rights of others.
• Harass, abuse, or harm any person, including the authors of the public posts we surface.
• Attempt to gain unauthorized access to the Service, its systems, or other users' accounts.
• Use the Service to build a competing demand-monitoring product or to scrape or resell our data in bulk.
• Interfere with or disrupt the operation of the Service.

5. Data and Content

The Service surfaces public Bluesky posts. You are responsible for how you use the information we surface and for complying with Bluesky's own terms of service and any applicable laws when you act on that information. We do not grant you any rights to the underlying posts beyond what the original authors and Bluesky permit.

You retain all rights to the content you submit to the Service, including your project keywords and saved opportunities. By submitting content, you grant us a limited license to store, process, and display it solely to provide the Service to you.

6. Fees and Payment

The Service may be offered free or on a paid subscription basis. If you subscribe to a paid plan, fees are charged in advance and are non-refundable except as required by law. We may change pricing by providing notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

7. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by DemandOrca and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. You may not copy, modify, distribute, or reverse engineer the Service except as permitted by law.

8. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access at any time, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including sections 5, 7, 9, 10, and 11) will survive.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT THE DEMAND SIGNALS WE SURFACE WILL LEAD TO COMMERCIAL SUCCESS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DEMANDORCA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless DemandOrca and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these terms, or your violation of any rights of a third party.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which DemandOrca is established, without regard to its conflict-of-law principles. Any disputes arising under these Terms will be resolved in the courts of that jurisdiction.
